AN ORDINANCE ENACTED BY THE QUORUM COURT OF _______COUNTY.
AN ORDINANCE ESTABLISHING RULES AND REGULATIONS REGARDING THE RESTRICTION AND SECURITY OF ANIMALS WITHIN _______COUNTY AND OUTSIDE THE LIMITS OF ANY INCORPORATED CITY.
SECTION 1. In order to protect all citizens of ________county in an equal and fair method, the Quorum Court hereby adopts the following rules and regulations regarding animals with the _______County and outside the limits of any incorporated city.
SECTION 2. For purposes of this ordinance, the following definitions are hereby set forth.
An exotic animal is defined as any animals other then domesticated dogs, domesticated cats, all hoofed animals, all flying animals, and fish. The exotic animals definition specifically includes lions, tigers, leopards, wolves, hyenas, dingos, coyotes, nears, and nonhuman primates.
A perimeter fence is defined as being at least 8 feet in height and at least 3 feet from a required primary enclosure fence or cage. A lean-in should be constructed atop the fence with at least three strands of barbwire attached that is separated by at least four inches but no more then five inches. The perimeter fence should be constructed of a heavy, closely woven wire (i.e. chain link fencing) or some other material such as wood or concrete that will not allow an animal to pass through it or tear it.
SECTION 3. All exotic animals must be contained within a perimeter fence as defined in Section 2.
SECTION 4. Areas where all types of animals are caged on confined in a relatively small area, such as city zoos, animal compounds, roadside zoos, etc., must have a perimeter fence as defined in Section 2.
SECTION 5. Any site that houses animals, may be classified as meeting the criteria in Section 3 and or Section 4 and, as a result, be required to meet the guidelines set forth by this ordinance. The sites to fall under the rules and regulations of this ordinance shall be determined by the ______County Office of Emergency Services Coordinator. This requirement can only be enforced after there has been a thorough inspection by the ______County Office of Emergency Services Coordinator, and the coordinator determined that the above requirements should be enforced. This determination shall be followed by written notification to the occupying resident of the site that he/she has 60 days from the date of notification to comply with this ordinance. The Office of Emergency Services Coordinator will automatically place any appeal of the Office of Emergency Services Coordinator's decision on the next regular meeting agenda of the Quorum Court. The Quorum Court will render a decision by a simple majority vote of the full membership. The Quorum Court reserves the right to delay the affectivity date by a majority vote for an indefinite period of time.
SECTION 6. All establishments housing either exotic animals or those that fall under the guidelines of Section 4 are required to submit to a quarterly inspection performed by the ______Department of Health by the first day of each calendar quarter (January 1, April 1, July 1, October 1). This inspection should be concluded with a general sanitation report to be provided to the Office of Emergency Services Coordinator.
SECTION 7. All establishments housing either exotic animals or those that fall under the guidelines of Section 4 are subject to an inspection by the Office of Emergency Services Coordinator to insure that all guidelines set forth by this ordinance are being complied with. Any non-compliance with this ordinance should be reported by the Office of Emergency Services Coordinator to the _____District Prosecuting Attorney's office and will result in a misdemeanor charge and a fine of $100 assessed on a daily basis against the occupying resident of the site in violations.
SECTION 8. If any provision of this ordinance or the applications thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable.
SECTION 9. This ordinance being necessary for the welfare and overall protection of the residents of _______County, an emergency is hereby declared to exist. This ordinance shall be in full force and effect on and after its passage and approval.
